The information we collect
- Contact details – your name, email address, phone number, postal address and postcode.
- Enquiry details – what you tell us when you contact us, such as whether you are selling, letting, buying or renting, and any messages you send.
- Property information – details of a property you ask us to value, sell, let or manage.
- Identity and verification information – where the law requires it (for example anti-money laundering and Right to Rent checks), proof of identity and address, and information about the source of funds.
- Financial and referencing information – for lettings, information needed for tenant referencing, rent and deposit handling; for sales, information needed to progress an offer.
- Marketing preferences – whether you have agreed to receive marketing emails from us.
- Website data – technical information such as your IP address and browser type, collected when you use our website.
How and why we use your information
- To respond to your enquiry and arrange valuations or viewings – because it is necessary to take steps at your request before entering into a contract, or in our legitimate interests in responding to people who contact us.
- To provide our agency services – marketing your property, negotiating offers, finding tenants, managing tenancies and handling client money – because it is necessary to perform our contract with you.
- To meet our legal obligations – including anti-money laundering checks under the Money Laundering Regulations 2017, Right to Rent checks, tenancy deposit protection, consumer protection law, and keeping records required by our redress scheme and regulators.
- To send you marketing emails – such as property news, market updates and invitations – only if you have given your consent. You can withdraw consent at any time using the unsubscribe link in any email or by emailing us.
- To run and improve our business and website – keeping records, handling complaints and keeping our systems secure – in our legitimate interests.
Who we share your information with
We never sell your personal information. We share it only where necessary with:
- Keller Williams UK and its technology providers, including the KW Command customer relationship management system, which we use to manage client records;
- service providers who support our business, such as our email provider (Google Workspace), website hosting provider, and tools that connect our website to our CRM;
- property portals, where you have instructed us to market a property;
- other parties to a transaction or tenancy, such as buyers, sellers, landlords, tenants, solicitors and conveyancers, and – with your agreement – mortgage brokers and surveyors;
- referencing, identity-verification and anti-money laundering check providers, and tenancy deposit protection schemes;
- our redress scheme, insurers and professional advisers; and
- regulators, local authorities, HMRC or law enforcement where the law requires it.
International transfers
Some of our service providers, including Keller Williams’ technology platform, may store or process information outside the UK, including in the United States. Where this happens, we make sure appropriate safeguards are in place, such as the UK Extension to the EU–US Data Privacy Framework or the UK International Data Transfer Agreement.
How long we keep your information
- Enquiries that do not lead to us working together: up to 2 years.
- Client, transaction and tenancy records: 6 years after the sale completes or the tenancy ends.
- Anti-money laundering records: 5 years after our business relationship ends, as required by law.
- Marketing preferences: until you unsubscribe, after which we keep only what we need to make sure we don’t contact you again.
Your rights
You have the right to access the personal information we hold about you, to ask us to correct or delete it, to restrict or object to how we use it, to data portability, and to withdraw consent at any time where we rely on it. To make a request, email hello@silliphant.co.uk. We will respond within one month.
If you are unhappy with how we have handled your information, please contact us first. You also have the right to complain to the Information Commissioner’s Office (ICO) at ico.org.uk/make-a-complaint or on 0303 123 1113.
Cookies
Our website uses cookies that are strictly necessary for it to work properly and securely. With your consent, we also use Google Analytics and Google Ads cookies to understand how people use our website and to measure how well our advertising works – for example, whether someone who clicked one of our adverts went on to contact us. These are only set if you click “Accept” on our cookie banner, and you can change your choice at any time using the “Cookie settings” link at the bottom of every page.
If you haven’t accepted, or you click “Reject”, no analytics or advertising cookies are set and nothing is stored on your device. Our pages still send Google a small amount of information without cookies, such as that a page was viewed or one of our adverts was clicked, along with basic technical details like your browser type. Google uses this only to estimate, in total, how many visits and enquiries our advertising produced, not to identify you. If you arrived from one of our adverts, its click reference may also be carried in the page address while you browse our site.
Our website also loads fonts from Google Fonts, which means your IP address is shared with Google when you visit.
